U.S. immigration offers family-based visas for individuals sponsored by a U.S. citizen or lawful permanent resident (LPR), including spouses, children, parents, and siblings. Categories include Immediate Relative (IR) visas and Family Preference (F) visas.
A green card grants lawful permanent residency in the U.S. Applicants may qualify through employment, family sponsorship, asylum, investment, or the Diversity Visa Lottery. The process includes adjustment of status (if in the U.S.) or consular processing (if abroad).
Spouses of U.S. citizens or green card holders can apply for CR-1 (conditional residence), IR-1 (permanent residence), or K-1 fiancé(e) visas. These visas allow spouses to live and work in the U.S. while awaiting their green card.
AOS allows eligible individuals already in the U.S. to apply for a green card without leaving the country. It applies to family-sponsored, employment-based, refugee/asylee, and certain special immigrant categories.
For green card applicants outside the U.S., consular processing involves applying through a U.S. embassy or consulate. After an interview and approval, the applicant can enter the U.S. as a lawful permanent resident.
Employment-based visas allow foreign workers to live and work in the U.S. These include temporary (H-1B, L-1, O-1, H-2B) and permanent (EB-1, EB-2, EB-3) options, depending on qualifications and job requirements.
The EB-5 Immigrant Investor Program provides a direct path to a green card for individuals who invest at least $800,000 in a U.S. business and create 10 full-time jobs for American workers.
The H-1B visa is for skilled professionals in specialty occupations (e.g., IT, engineering, healthcare). It requires employer sponsorship and is valid for up to 6 years with green card sponsorship options.
The H-2B visa allows U.S. employers to hire foreign workers for temporary non-agricultural jobs (e.g., hospitality, landscaping, construction, and ski stations). It is valid for up to 1 year, with extensions available.
The EB-1 visa is for individuals with extraordinary ability (O-1), outstanding professors and researchers, or multinational executives. It offers priority green card processing with no labor certification required. Petitioners may self sponsor, meaning they do not need an employer to apply for this type of visa.
The EB-2 National Interest Waiver (NIW) allows highly skilled professionals and entrepreneurs to bypass employer sponsorship if their work benefits the U.S. in areas like science, technology, or healthcare.
VAWA allows victims of domestic violence, abuse, or extreme cruelty by a U.S. citizen or green card holder spouse, parent, or child to self-petition for a green card without their abuser’s knowledge.
The U visa protects victims of serious crimes (e.g., domestic violence, human trafficking, assault) who assist law enforcement in investigations. It grants temporary legal status with a path to a green card.
The T visa is for individuals trafficked into the U.S. for forced labor or commercial sex. It provides work authorization, protection from deportation, and a path to permanent residency.
Waivers allow individuals barred from entering the U.S. due to previous immigration violations, health issues, or criminal records to request legal forgiveness and regain eligibility for a visa or green card.
Individuals inadmissible to the U.S. (due to unlawful presence, certain crimes, or misrepresentation) may apply for an I-601 waiver if they can prove denial would cause extreme hardship to a U.S. citizen or LPR relative.
Persecution waivers apply to individuals facing persecution in their home country due to race, religion, nationality, or political opinion. Certain J-1 visa holders can also seek waivers to avoid returning to their home country.
